In Ancient Greece, the figure of the hero was identified as a demigod, possessed of altruistic and virtuous deeds. When Pierre de Coubertin reinstated the Olympic Games, the athlete was personified as a modern hero. Its antithesis, the anti-hero, has more virtue that defects, no evil but he does not care on the means to achieve his goals. In the eyes of everyone involved in sports competition, these characters captivate and at the same time, create conflicts of ethics and aesthetics. (...) The purpose of this paper is to perform an ethical reflection linked to principles that contribute for the human growth and accomplishment, as well as the aesthetic on the perception of the sensitive, reverberated by sensations and feelings emerging from athletes. Connecting the ethic with the aesthetic spheres, we could have in the sports a phenomenon walking toward a common point between moral and aesthetic, between the good and the beauty. (shrink)

Spanish Abstract: A partir de un análisis desde la historia del derecho, este artículo de investigación busca demostrar la existencia de un significado de justicia social en el discurso jurídico transnacional actual que se resume en la garantía de estos tres elementos: Estado Social de Derecho, dignidad humana e igualdad de oportunidades. Con esto, se pretende superar el simple estudio de teorías de filósofos de moda como John Rawls a la hora de abordar el problema de cómo entender y materializar (...) la justicia social, particularmente, en el plano constitucional. Finalmente, con la ayuda de algunos breves estudios de caso, se espera proveer un marco mínimo útil para entender cómo la justicia social puede lograrse a través del derecho. -/- English Abstract: Based on an analysis from legal history, this paper seeks to prove the existence of a meaning of social justice in the current transnational legal discourse that can be synthetized in the warranty of these three elements: Social Rule of Law, human dignity, and equal opportunities. Thus, it aims to overcome the mere study of theories of justice drawn up by trendy philosophers like John Ralws when addressing the problem on how to understand and achieve social justice, specially, in constitutional law. English Abstract: Through the presentation of the history of social justice in global constitutional discourse, this article aims to demonstrate that, although in Colombia there is not a constitutionalized purpose or principle of social justice, as in other countries, the modern notion of distributive justice, also called social justice today, is implicit in the Constitution of 1991 because it enshrined as mandatory rules the three main elements of its meaning at the time of its promulgation: the principle of social rule (...) of law, the principle of human dignity and the right to a material equality. Thus, in Colombia social justice must not be understood in the Aristotelian sense of distributive justice but in accordance with these three elements, and can only be achieved if they are fulfilled. -/- Spanish Abstract: Mediante la presentación de la historia de la justicia social en el discurso constitucional global, este artículo pretende demostrar que, a pesar de no existir en Colombia, como en otros países, un valor o principio constitucional de justicia social, la noción moderna de justicia distributiva, también llamada hoy justicia social, se encuentra implícita en la Constitución de 1991 porque esta consagró como normas obligatorias los tres elementos principales de su significado en el tiempo en el que fue promulgada: el principio de Estado Social de Derecho, el principio de dignidad humana y el derecho a una igualdad material. Justo antes de la pandemia por COVID-19, la Organización Mundial de la Salud definió unas prioridades de trabajo para la década 2020-2030. Un grupo interdisciplinario de profesionales de la salud reflexiona sobre estas prioridades, determinando unas categorías de análisis y, desde una perspectiva bioética, analiza cada una de ellas, ve su pertinencia, algunos eventos causales, las implicaciones que pueden tener si no son enfrentadas adecuadamente y hace sugerencias sobre la forma de llevarlas a cabo. En esta primera entrega se analiza (...) el primer grupo de prioridades estratégicas: “poblaciones más sanas”. En las conclusiones se destaca la conveniencia de acometer cada una de ellas de una manera colaborativa, gubernamental y privada; de reestructurar el sector salud con base en estas prioridades, aprovechando la experiencia obtenida en la lucha contra el COVID-19. La relación del ser humano con el medio ambiente también debe cambiar, apelando a la responsabilidad humana por el cuidado del planeta. (shrink)

Esta investigación retoma la obra de Gabriel García Márquez, Noticia de un secuestro (1996), con la volición de cuestionar la idea de Estado nación que está inmersa en el libro. Para ello, es necesario entender que la naturaleza del texto exige un conocimiento amplio al lector o al intérprete, puesto que su contenido revela datos multidisciplinarios. Además, es insoslayable realizar un análisis discursivo de la historia de ese contexto y cotejar con pasajes del mismo libro. Para facilitar esta labor, la (...) extrapolación de conceptos del teórico Luis Rodríguez Manzanera será de utilidad, ya que él despliega definiciones de Criminología, un tema frecuente en la obra. Verbigracia, la macrocriminalidad, una noción que él postula, permite que se comprenda la complexión del periodo histórico finisecular del siglo XX en Colombia, etapa que le corresponde a Noticia de un secuestro. Por otro lado, es menester dilucidar que este estudio no se reduce a lo literario, lo histórico y lo criminológico, sino que abarca distintas disciplinas, por lo que la exigencia en la consolidación epistemológica e interpretativa estará demostrada consuetudinariamente, sin obviar la inmanencia de la obra. Este tipo de análisis interdisciplinarios ya ha sido trabajado desde los Estudios Culturales, tal como se constata en las investigaciones de Richard Johnson (2000) o Néstor García Canclini (1997). De igual modo, el intento de establecer lineamientos y conexiones entre disciplinas como las de Literatura y Derecho ya ha sido desarrollado por Stanley Fish (1986), Faustino Martínez (2005), Carlos Pérez (2006) y Denise Schalet (2014). A diferencia de estos abordajes ya estudiados, el objetivo de esta investigación es detectar y fundamentar cómo se articula una propuesta ideológica desde una configuración que reanuda elementos históricos y literarios. En específico, lo que se busca es argumentar por qué fracasó implícitamente un proyecto sociopolítico de democracia y progreso, a partir de un panorama de violencia, narcoterrorismo, corrupción, negociaciones ilícitas, transgresión a los derechos humanos e inseguridad ciudadana. Con todo ello, esta tesis de maestría terminará siendo fructuosa para análisis postremos de discursos que tienen como esencia un soporte multidisciplinario. (shrink)

En los últimos tiempos el derecho ambiental ha ganado un puesto importante en el ámbito jurídico, hecho que refleja la preocupación que hoy se tiene por la relación del hombre con su entorno. Desde hace quince años, la Universidad Colegio Mayor de Nuestra señora del Rosario, por intermedio de su Facultad de Jurisprudencia y concretamente de la Especialización y la línea de investigación en Derecho Ambiental, ha propuesto a través de diversos proyectos avanzar en el conocimiento y análisis del ordenamiento (...) jurídico ambiental, aportando así al desarrollo, estructura y consolidación de esta rama jurídica. Bajo estos parámetros, el objetivo de esta publicación es hacer algunas reflexiones en torno a distintos temas que dentro del derecho público impactan o influyen al derecho ambiental y responder a los enormes desafíos que se presentan en la materia. Por tanto, el programa quiere contribuir desde la academia al diálogo crítico y propositivo que permita dar solución a los problemas encontrados en la aplicación del derecho ambiental. En el primer capítulo, Gloria Amparo Rodriguez describe los ordenamientos jurídicos constitucionales de Colombia, Ecuador y Bolivia a fin de analizar la forma en que cada uno de ellos consagra el derecho a un ambiente sano. A continuación, Martha Ovalle y Zelba Nidia Castro de Perez realizan un estudio de los principios de precaución y prevención, exponiendo su alcance, su fundamento desde el derecho internacional y cómo vienen siendo entendidos por nuestro ordenamiento jurídico, tanto jurisprudencial como legal. Luis Adolfo Diazgranados se ocupa de la responsabilidad de los funcionarios públicos en materia ambiental, para lo cual realiza un análisis de los deberes consagrados en la normatividad vigente. Continuando con esta temática, el profesor Jorge Agudo Gonzalez, de la Universidad Autónoma de Madrid, explora la incidencia del ambiente y los recursos naturales en los procesos contractuales, a fin de mostrar cómo estas materias se han constituido en variable fundamental en el devenir de la formación, celebración y ejecución de los contratos, desde un punto de vista crítico, los aspectos importantes del proceso sancionatorio ambiental, evidenciando las falencias y vacios del a Ley 1333 de 2009. Jairo Cabrera plantea algunas reflexiones sobre la responsabilidad, valiéndose de la doctrina internacional, sobre la problemática de la reparación por daño ambiental. Por su parte, Leonardo Güiza Suárez explica el régimen general de la responsabilidad ambiental en el ordenamiento jurídico a partir del daño de los bosques naturales y su incidencia sobre los derechos humanos. Andres Gomez Rey, desde la teoría del acto administrativo, desarrolla el análisis crítico del régimen jurídico de las aguas superficiales en el derecho ambiental. Giovani J. Herrera Carrascal realiza una disertación sobre los recursos naturales y el ambiente como elementos del espacio público que a su vez constituye en un componente del medio ambiente urbano a partir de la jurisprudencia y de las competencias respectivas. Por último, Marybell Ochoa Miranda trate el tema de los residuos hospitalarios en Colombia, exponiendo su régimen jurídico, las competencias de las autoridades ambientales, los deberes que en estos asuntos tienen los ciudadanos, proponiendo lineamientos para avanzar en la consolidación de la gestión integral de residuos hospitalarios y similares. INTRODUÇÃO A técnica da inseminação artificial tornou possível aumentar o impacto na descendência de touros geneticamente superiores em termos de produção láctea das filhas. Com a transferência de embriões é possível aumentar o impacto da fêmea sobre (...) a população das filhas. A transferência de embriões data de 1890, ano em que Heape obteve o nascimento de coelhos transferindo ovócitos fecundados de uma fêmea para outra. A partir de 1930, é repetida uma série de experiências para desenvolver a técnica e aplicá-la em ovinos, caprinos (1934) e bovinos (1951) como espécies mais idôneas para a reprodução. A Inglaterra e os Estados Unidos estabeleceram as bases para o comércio de embriões durante os anos sessenta e setenta. De forma resumida, a transferência de embriões implica na estimulação da produção de ovócitos mediante a aplicação de hormônios: cerca de 6-8 dias após a cobrição dessas fêmeas ou da sua inseminação artificial, os óvulos fertilizados são extraídos dos órgãos genitais da fêmea doadora por perfusão ou lavagem com soluções biológicas controladas e testadas, originando-se uma deposição dos gametas fecundados nas fêmeas receptoras que serão encarregadas de levar adiante a gestação e o parto sem influência sobre as produções do novo indivíduo. 2. MANEJO DAS FÊMEAS DOADORAS É relativamente fácil obter um embrião, uma vez que pode origina-se a partir do cio natural das vacas cíclicas. No entanto, a fim de otimizar a técnica, o normal é «superovular» a fêmea doadora e obter um número superior de gametas fecundadas após cada lavagem ou perfusão das genitais. A maioria das fêmeas doadoras são tratadas com gonadotrofinas (PMSG) ou com hormônios estimuladores da foliculogênese (FSH). Estes hormônios invertem a atresia normal de folículos permitindo uma maturação, que em condições normais não se realizaria. O mecanismo exato do funcionamento destas hormonas não é totalmente claro. A superovulação multiplica por um fator de 10 o número de ovócitos recuperados no caso das vacas, ovelhas e cabras, mas apenas por um fator 2 ou 3 no caso das porcas. Existe um acordo geral sobre a utilização das gonadotrofinas; a PMSG deve ser aplicada durante a transição da fase luteica para a folicular, ou seja, no 16º dia do ciclo. As doses de gonadotrofinas variam entre 1500 e 3000 UI em bovinos, aumentando a resposta e a variabilidade individual com o aumento da dose. A resposta ao tratamento varia de acordo em função de diversos fatores. Neste contexto, merecem especial atenção a espécie, a raça, a época e a conformação corporal do animal, bem como o lote de fabricação da preparação hormonal (quadro 7.1). Estudos demonstram que, nos bovinos, as raças de corte respondem melhor ao tratamento do que as raças leiteiras. O FSH também é utilizado para superovulação em várias espécies. Nos ovinos, injetam-se 2 mg desta hormona 12 horas antes da retirada das esponjas, aplicando-se mais três injeções, com um intervalo de 12 horas, até 24 horas após a retirada das esponjas, o que corresponde a um total de 8 mg de FSH injetados por tratamento e animal. Às vezes, e dependendo do país, existem dificuldades para a obtenção desse hormônio em condições de pureza adequada para que o tratamento proporcione o resultado esperado. Nas vacas dadoras devem ter passado mais de 50 dias após o último parto: também ser animais cíclicos, encontrar-se num nível nutricional elevado e em aumento, sem deficiências especificas alimentares. Existe uma indicação de suplementação das fêmeas doadoras com minerais essenciais antes do tratamento. 3. OBTENÇÃO DE EMBRIÕES Uma vez as fêmeas doadoras inseminadas, entre o sexto e o oitavo dia, procede-se a coleta dos embriões. Para isso, atualmente se utilizam cateteres de obtenção transcervical (tipo Foley, Rusch. etc.) munidos de uma bola insuflável na sua extremidade que permite criar um compartimento estanque na parte distal do córneo uterino e proceder ao arrasto dos embriões ali localizados. Para obter esta «lavagem» utiliza-se uma solução aquosa tamponada: o meio mais frequentemente utilizado é o tampão fosfato salino (PBS: pH = 7; PO = 280 - 290 mOsm/kg) suplementado com antibióticos e proteínas. Depois de recuperado o meio de lavagem, os embriões devem ser isolados do volume total, avaliados segundo critérios do Manual da Sociedade Internacional de Transferência de Embriões de acordo com seu estado de desenvolvimento. Código numérico para determinar o grau de desenvolvimento embrionário: N° 1: ovócito não fertilizado ou embrião de uma célula (1 dia). N° 2: Identifica embriões com 2 a 16 células (2-4 dias). N° 3: Identifica mórulas adiantadas (5-6 dias). N° 4: Identifica mórulas compactas de 6 dias de idade. N° 5: blastocisto adiantado (7 dias). N° 6: blastocisto (7-8 dias). N° 7: blastocisto expandido (8-9 dias). N° 8: blastocisto eclodido (9 dias) a partir do nono ou décimo dia o blastocisto já está fora da zona pelúcida. Além da classificação por estado de desenvolvimento, a referida Sociedade Internacional estabeleceu uma categorização dos embriões com base na qualidade dos mesmos. Assim os denomina: 1: excelente; 2: bom; 3: regular; 4: degenerado. Segundo as investigações de diversos autores especialistas no tema não devem ser transferidos embriões que não tenham sido classificados como excelentes ou bons. A obtenção dos embriões pode ser realizada em uma clínica, em unidades móveis especializadas, ou na própria fazenda. Em todo o caso, a doadora não deve apresentar quaisquer sintomas clínicos de doença, sendo esta responsabilidade direta do veterinário. O rebanho de onde provém a doadora deve estar livre de medidas cautelares sanitárias. Os técnicos devem estar adequadamente limpos e preparados para esta atuação, em um lugar tranquilo e que permita a colocação de equipamentos e material em condições limpas e seguras. 4. TÉCNICAS DE TRANSFERÊNCIA DE EMBRIÕES Recomenda-se que os embriões sejam transferidos o mais rápido possível depois da recuperação. A fêmea receptora deve apresentar um ambiente uterino o mais semelhante possível ao da fêmea doadora. Isto quer dizer que a receptora também será mantida num sistema de sincronização para que coincida o mais possível o estágio de desenvolvimento embrionário com seu correspondente estado uterino. A margem de assincronia para evitar efeitos indesejáveis é de ± 24 horas. Os métodos hormonais de sincronização são análogos aos das doadoras. As técnicas para a deposição dos embriões no seu novo habitat podem ser igualmente cirúrgicas e não cirúrgicas, mas devido aos problemas do uso de anestésicos em técnicas cirúrgicas, as transferências foram direcionadas para modelos não-cirúrgicos ou transcervicais. Este método é baseado na utilização do colo uterino de forma análoga como é realizada na inseminação artificial. Devido às relações entre o embrião e o ovário, as porcentagens de fertilidade são aumentadas ao serem depositadas no corno ipsilateral no ovário que se encontra ativo. A utilização desta técnica implica na obtenção de mais fêmeas gestantes. O uso de novilhas como fêmeas receptoras aumenta também a taxa de gestações a partir de uma maior facilidade de manejo, uniformidade na resposta hormonal e um custo mais baixo. O fator humano ou habilidade do técnico que realiza esta técnica também constitui um fator que influencia decisivamente no êxito da transferência, encontrando-se variações de 20 a 60% devidas a este fator. 5. CONTROLES SANITÁRIOS Com a utilização da inseminação artificial, verificou-se que, embora as tecnologias reprodutivas colaborativas fossem mais avançadas em termos de técnicas destinadas a aumentar a produtividade individual, da mesma forma, podem constituir um perigo de contaminação e de dispersão de doenças estrangeiras para o grupo ou rebanho para onde são transferidos os novos genes. Neste contexto, a transferência embrionária (TE) deve realizar-se tendo em conta os riscos que pode implicar uma manipulação inadequada. Uma vez mais, a Sociedade Internacional (IETS) na Reunião Regional da OIE (Oficina Internacional de Epizootias) estabeleceu as normas em 1985 para que a TE pudesse ser utilizada como meio para controle de doenças na pecuária. Para que a utilização da TE se realize sem risco para a saúde, é necessário ter em conta um certo número de regras e condições específicas que evitem os riscos de contaminação. O embrião está separado do meio externo por três barreiras de proteção: o corpo da mãe, o útero por si só e a terceira, e mais importante, pela zona pelúcida, a qual nos animais domésticos tem demonstrado ser totalmente impermeável a qualquer elemento patogênico, desde que fique intacta. Portanto, o risco de contaminação dos embriões pode vir por duas vias diferentes: a) Fatores extrínsecos - por invasão dos agentes patogênicos na cavidade uterina principalmente. Isto está relacionado com o estado sanitário médio do país, região ou rebanho de origem. b) Fatores intrínsecos - Segundo Thibier podemos considerar diferentes fontes potenciais de contaminação, que segundo o risco sanitário se classificam nas seguintes ordens: 1° Zigoto. 2° Penetração. 3° Absorção. 4° Armazenamento. 5° Exame. 6° Transferência. Os esforços para que os embriões se tornem livres de contaminação devem ser semelhantes aos que são efetuados com os animais vivos e com as doses seminais. O momento mais perigoso encontra-se entre a coleta das células fecundadas e a sua deposição, após seu exame, no trato reprodutivo da receptora. As condições em que o referido processo deve ser realizado encontram-se detalhadas no manual da Sociedade Internacional de Transferência de Embriões (IETS). 6. REGRAS DA IETS A transferência de embriões é a via mais segura para a troca de genes. No entanto, os técnicos devem esforçar-se por manter todas as regras e normas sanitárias para que a coleta e a manipulação dos embriões se realizem sob condições de absoluta garantia higiênica e sanitária. A transferência embrionária implica, pela primeira vez na história da medicina veterinária, que a vigilância sanitária não se aplica estritamente ao animal, uma vez que, na sua fase "in vitro", está inteiramente sob o controle do técnico. Por conseguinte, não haverá futuro para este tipo de biotecnologia se, paralelamente, não houver um elevado nível de garantia de que não «servirá» para não disseminar ou difundir doenças. As conclusões da Sociedade Internacional de Transferência de Embriões (IETS) na sua reunião anual de 14 de Janeiro de 1992 estabelecem, tendo em conta a revisão efetuada em 1991 pela Subdireção de Investigação e pelo Comitê de Importação e Exportação, uma classificação das doenças. Esta classificação corresponde às seguintes categorias: Categoria 1 - Doenças ou agentes de doenças para as quais foram recolhidas provas suficientes para afirmar que o risco de transmissão é negligenciável, desde que os embriões sejam corretamente manipulados entre a coleta e a transferência: a) Leucose bovina enzoótica. b) Febre aftosa (bovinos). c) Língua azul (bovinos). d) Brucelose bovina. e) Rintraqueíte infecciosa bovina. f) Doença de Aujeszky. Categoria 2 - Doenças para as quais foram recolhidas provas substanciais que indicam que o risco de transmissão é insignificante, desde que os embriões sejam corretamente manipulados entre a coleta e a transferência, mas para as quais é necessário verificar os dados existentes através de novas transferências: a) Peste suína clássica. Categoria 3 - Doenças ou agentes de doenças para as quais os resultados preliminares indicam que o risco de transmissão é insignificante, desde que os embriões sejam corretamente manipulados, entre a coleta e a transferência, mas para os quais essas verificações preliminares devem ser corroboradas por dados experimentais complementares "in vitro" e "in vivo": a) Peste bovina. b) Diarreia viral bovina. c) Língua azul (ovinos). d) Febre aftosa (suínos, ovelhas e cabras). e) Campylobacter fetus (ovinos). f) Doença vesicular do porco. g) Peste suína africana. h) Prurido lombar (ovinos). i) Haemophilus somnus. Categoria 4 - Doenças ou agentes de doenças que foram ou são objeto de trabalhos preliminares: a) Vírus Akabane (bovino). b) Estomatite vesicular (bovinos e suínos). c) Chlamydia psittaci (bovinos e suínos). d) Ureaplasma/micoplasmose (bovinos e caprinos). e) Maedi-visna (ovino). f) Adenomatosa pulmonar (ovino). g) Prurido lombar (caprinos). h) Língua azul (caprinos). i) Artrite e encefalite caprina. j) Parvovírus (suíno). k) Enterovírus (bovinos e suínos). I) Leptospirose (suíno). m) Herpesvírus 4 dos bovinos. n) Mycobacterium paratuberculose (bovinos). o) brucelose ovina. p) Doença de Border (ovinos). q) Vírus parainfluenza 3 (bovinos). r) Agente da encefalopatia espongiforme bovina. É interessante salientar que apenas seis doenças estão incluídas na categoria 1 (a mais segura). Isso não significa que as outras doenças tenham um risco maior, apenas indica que o risco de transmissão das doenças da categoria 1 é irrelevante, estatisticamente falando. É importante assinalar que as doenças mais importantes dos bovinos se situam na categoria 1. Isto significa que a incidência do embrião patogênico nos bovinos parece ser perfeitamente controlável, desde que sejam adotadas metodologias adequadas. Isto serve também como linha de defesa adicional para que o técnico centre sua atenção e cuidados entre a fase de obtenção e a de transferência. 7. SITUAÇÃO ATUAL DA TRANSFERÊNCIA DE EMBRIÕES ANIMAIS NO BRASIL O Brasil é um dos grandes responsáveis mundiais pela implantação da tecnologia na reprodução animal, sendo assim, o país conseguiu inserir-se no mercado internacional como um dos maiores produtores de embriões in vivo e in vitro. Nas últimas duas décadas, especialmente entre os anos de 1997 e 2017 o país passou por importantes transformações nesse segmento, dentre essas transformações vale destacar a posição relativa do Brasil no contexto mundial. O Brasil passou de referência regional, nos anos 1990, para se tornar o maior produtor mundial de embriões entre os anos 2012 e 2013, sendo líder no uso e na produção de embriões in vitro. Os primeiros registros da TE produzidos in vivo no Brasil datam da década de 1980, e uma década depois o país já tornara-se referência e detinha um mercado consolidado de produção e TE na espécie bovina. Não obstante, no ano de 1997 o país ainda era referência apenas no contexto regional, detendo 68,3% dos embriões transferidos na América Latina, esse percentual corresponde a 24.085 embriões de um total de 35.254 produzidos na América Latina. Esse percentual regional representa apenas 6,6% de toda a produção mundial de embriões in vivo, que produziu, em 1997, 360.656 embriões in vivo. Nos últimos anos, o mercado de embriões, principalmente o bovino, teve retração moderada de -2,5% ao ano entre 2003 e 2018, porém essa retração contrasta com o ligeiro crescimento observado a partir dos anos 2000 conforme figura 1: Figura 1: Produção de embriões bovinos no Brasil no período 1996-2018, total e por tecnologia adotada (in vivo[IVD] ou in vitro [IVP]). Em 2018, o mercado de embriões bovinos manteve-se inalterado se compararmos com os três anos anteriores, houve reduções nós segmentos de corte, leite e no total comparado ao ano de 2017. Em 2014, a produção de embriões para melhoramento do gado leiteiro teve seu ápice, porém de lá para cá esse mercado manteve-se estagnado como demonstra a tabela 2. Tabela 2: Produção de embriões bovinos no Brasil em 2018, estratificada por segmento e por tecnologia adotada (in vivo ou in vitro). 7.1 Crise, economia e mercado de embriões A indústria de embriões reflete, em maior ou menor grau, o momento da economia brasileira. Apesar do segmento agropecuário ser um setor em constante crescimento no país, ao qual, sem dúvidas, em meio a inúmeras crises mantém-se em constante crescimento. Porém vale ressaltar que esse mercado é emergente e está refletido em paralelo com os bens produzidos pelo país, como demonstra a figura 2. Figura 2: Produção de embriões bovinos e variação no produto interno bruto (PIB) no Brasil, no período 1996-2018. Cada vez mais o setor agropecuário do Brasil investe em novas tecnologias que maximizem o mercado e que melhore a produção dos animais seja no segmento corte ou leite. Segundo a OCDE, 1997, essa indústria da produção de embriões é um conjunto de novas técnicas e processos, frutos do desenvolvimento técnico-científico, que chega ao mercado e - o mais importante - o transforma. Logo, todas essas técnicas e biotecnologias visam, além da alta produção e do lucro, o melhoramento e a suplementação alimentícia da população mundial que está em crescente avanço. A evolução da tecnologia embrionária no país, seja para o melhoramento dos equinos para os esportes como as vaquejadas, hipismo, corridas, etc., onde são investidos tempo, dedicação e dinheiro para formar um novo animal que apresente força, conformação, conversão alimentar e que custa milhões, em muitos casos, não só dos equinos, mas também dos caprinos, ovinos, suínos e até mesmo os bovinos onde o mercado da TE é mais presente e aquecida, venceu os estigmas do “modismo” e o chamado “elitismo”, porém deve enfrentar novos desafios, em especial num contexto de forte concentração do mercado de genética e de concorrência globalizada. Mesmo com todos esses avanços e retrocessos, essa relativização dos números demonstra que um percentual bastante reduzido das fêmeas bovinas que estão em idade reprodutiva é utilizado para a técnica da transferência de embriões, e que o mercado brasileiro ainda tem um grande potencial de crescimento no setor de produção in vivo e in vitro. 8. RESUMO E PRIMEIRAS CONCLUSÕES Ao longo deste trabalho pretendi realizar uma revisão sumária sobre um tema de grande importância presente, e sobretudo futura; referir-me à transferência embrionária. Atualmente, esta técnica atingiu um grau notável de penetração, a nível prático, no gado leiteiro. No entanto, num futuro mais ou menos longínquo, não temos dúvidas quanto a esta técnica, pelas vantagens indubitáveis que apresenta a nível de avanço genético, que será aplicada em outras espécies úteis ao homem. Na minha exposição, tentei dar especial ênfase a dois aspectos: as técnicas de transferência, incluindo as normas IETS e os controles sanitários a serem efetuados. The complex world of thought and sensitivity in the sphere of contemporary art has entailed the revision and exclusion of disciplines aimed at providing a model to explain and conceptualize reality. Art history, as one such discipline, has had many of its contributions questioned from Gombrich’s epistemological reformulation to the postmodern discourses, which extol the death of the author, the post-structuralist idea of tradition as a textual phenomenon, and the declaration of the death of history as a consequence of the (...) hybridization of disciplines and of other bran- ches of human knowledge. Nevertheless, it can be demonstrated that proposals as those by Julius von Schlosser and Giulio Carlo Argan enclose reflections and methodological aspects which can help us face the task of understanding and visualizing the mediating role of historians in the culture of sensitivity, and the art modulations that have resulted from the blows of history and that, in turn, have shaped both art and art history into what they are or can be to us today. Laura Specker Sullivan (2022) makes a fairly compelling case for the value of the perspectives of Buddhist practitioners in neuroethics. In this study, Tibetan Buddhist monks have been asked, among other things, whether consciousness, in brain-injured patients in a minimally conscious state, entails a duty to preserve life. In our view, some of the participants’ responses could be used to inform the bioethical debate on death determination.

Pérez Carballo adopts an epistemic utility theory picture of epistemic norms where epistemic utility functions measure the value of degrees of belief, and rationality consists in maximizing expected epistemic utility. Within this framework he seeks to show that we can make sense of the intuitive idea that some true beliefs—say true beliefs about botany—are more valuable than other true beliefs—say true beliefs about the precise number of plants in North Dakota. To do so, however, Pérez Carballo argues that we must (...) think of the value of epistemic states as consisting in more than simply accuracy. El paper realiza una exposición sobre el concepto y contenido de la nulidad y el restablecimiento del derecho como medio de control a la luz de la Ley 1437 de 2011; enfocándola en asuntos ambientales a través del estudio de la licencia ambiental.

El presente estudio busca describir fenomenológicamente la forma que exhibe la pena en el cuerpo, después de la pérdida de un ser querido. Para esto, se consideran las hipótesis de movimiento centrı́peto orientado a la autoafección, y movimiento centrı́fugo aludido a la ruptura de la intercorpereidad. Ambos movimientos, hacen referencia a la sensación ambigua que el cuerpo vive en la pena asociados a la presencia y ausencia del otro que ya no está, ya que el dolor provee un estado de (...) desincronización temporal que vuelve simultáneos el presente-pasado y presente-futuro. Esto trae como consecuencias, la contracción y extensión del cuerpo a partir de la maleabilidad de sus propios lı́mites. (shrink)

Speech Acts, Criteria and Intentions What makes a speech act a speech act? Which are its necessary and sufficient conditions? I claim in this paper that we cannot find an answer to those questions in Austin's doctrine of the infelicities, since some infelicities take place in fully committing speech acts, whereas others prevent the utterance from being considered as a speech act at all. With this qualification in mind, I argue against the idea that intentions—considered as mental states accomplishing a (...) causal role in the performance of the act—should be considered among the necessary conditions of speech acts. I would thus like to deny a merely ‘symptomatic’ account of intentions, according to which we could never make anything but fallible hypotheses about the effective occurrence of any speech act. I propose an alternative ‘criterial’ account of the role of intentions in speech acts theory, and analyse Austin's and Searle's approaches in the light of this Wittgensteinian concept. Whether we consider, with Austin, that speech acts ‘imply’ mental states or, with Searle, that they ‘express’ them, we could only make sense of this idea if we considered utterances as criteria for intentions, and not as alleged behavioural effects of hidden mental causes. The classification of preserved hypothalamic activity in brain death and brainstem death as functional or non-functional has become a subject of debate. While proponents of the neurological criterion claim that these activities lack functional significance (Shemie et al. 2014), Nair-Collins and Joffe (2023) argue for their functional physiological role. However, the interpretation of the term "function" within the medico-legal framework, where death is characterized by the irreversible cessation of all brain functions, remains unclear. -/- My intention here is not to (...) engage in a debate over the validity of different viewpoints regarding the functional significance of preserved activities in the hypothalamus or the heart. Rather, I aim to highlight the critical importance of exploring and defining the concept of function in medicine, which currently lacks clarity. My point is that, whatever our position in the brain death debate, reaching a consensus on this conceptual matter would minimize misunderstandings and establish a robust foundation for further insightful analysis. The philosophical conception of mechanistic explanation is grounded on a limited number of canonical examples. These examples provide an overly narrow view of contemporary scientific practice, because they do not reflect the extent to which the heuristic strategies and descriptive practices that contribute to mechanistic explanation have evolved beyond the well-known methods of decomposition, localization, and pictorial representation. Recent examples from evolutionary robotics and network approaches to biology and neuroscience demonstrate the increasingly important role played by computer simulations and mathematical (...) representations in the epistemic practices of mechanism discovery and mechanism description. These examples also indicate that the scope of mechanistic explanation must be re-examined: With new and increasingly powerful methods of discovery and description comes the possibility of describing mechanisms far more complex than traditionally assumed. In spite of being ubiquitous in life sciences, the concept of information is harshly criticized. Uses of the concept other than those derived from Shannon's theory are denounced as pernicious metaphors. We perform a computational experiment to explore whether Shannon's information is adequate to describe the uses of said concept in commonplace scientific practice. Our results show that semantic sequences do not have unique complexity values different from the value of meaningless sequences. This result suggests that quantitative theoretical frameworks do (...) not account fully for the complex phenomenon that the term “information” refers to. We propose a restructuring of the concept into two related, but independent notions, and conclude that a complete theory of biological information must account completely not only for both notions, but also for the relationship between them. The notion of a correct appreciation of nature, like the one put forward in Carlson’s environmental account, has been rejected by many other authors in the aesthetics of the natural environment. Their critics challenge the idea that only scientific cat- egories can ground the aesthetic appreciation of nature as nature, and they hold that there is not a correct way of appreciating nature. However, they may share with Carlson the idea of correctness under an objectivist paradigm of aesthetic appreciation, according (...) to which correctness means the adequation of the experi- ence to properties of the object. My aim in the article is to claim that it is necessary to endorse an aesthetic standard of correctness that takes into consideration the subjective character of aesthetic appreciation. An aesthetic standard of correct- ness implies universal assent, or validity for everyone in Kantian terms, in place of an objectivist notion. This notion of correctness permits the inclusion of expressive perception of nature as an essential form of aesthetic appreciation. (shrink)

50 years after its introduction, brain death remains controversial among scholars. The debates focus on one question: is brain death a good criterion for determining death? This question has been answered from various perspectives: medical, metaphysical, ethical, and legal or political. Most authors either defend the criterion as it is, propose some minor or major revisions, or advocate abandoning it and finding better solutions to the problems that brain death was intended to solve when it was introduced. Here I plead (...) for a different approach that has been overlooked in the literature: the philosophy of science approach. Some scholars claim that human death is a matter of fact, a biological phenomenon whose occurrence can be determined empirically, based on science. We should take this claim seriously, whether we agree with it or not. The question is: how do we know that human death is a scientific matter of fact? Taking the philosophy of science approach means, among other things, examining how the determination of human death became an object of scientific inquiry, exploring the nature of the brain death criterion itself, and analysing the meaning of its core concepts such as “irreversibility” and “functions”. This paper investigates the differences between ancient Greek and modern ethical naturalism, through the account of the whole classical tradition provided by Cicero in De finibus bonorum et malorum. Ever since Hume’s remarks on the topic, it is usually held that derivations of normative claims from factual claims require some kind of proper justification. It ́s a the presence of such justifications in the Epicurean, Stoic, and Academic-Peripatetic ethical theories (as portrayed in De finibus), and, after a negative conclusion, I (...) argue that we should conceive of this issue within a social-historical perspective: The radical difference between ancient and modern naturalistic ethics is due (in Weber’s terms) to the rationalization processes that generated the modern outlook on nature. Hume presenta su teoría estética en el ensayo Sobre el criterio del gusto [On the Standard of Taste], en el que propone la existencia de un criterio [standard] capaz de zanjar discusiones de gusto. Ese criterio se basa en la existencia de ciertas formas y cualidades que complacen naturalmente a todo ser humano. Hume asevera que tal criterio corresponde a la opinión del crítico: un hombre que ha desplegado particularmente sus facultades cognoscitivas, lo cual le permite percibir esas finas cualidades (...) que suscitan naturalmente el placer de lo bello en el ser humano. Con respecto a en qué consisten esas formas y cualidades universalmente placenteras, Hume guarda silencio. Pretendo mostrar cómo la teoría de la emoción en la música desarrollada por Leonard Meyer en su texto Emoción y significado en la música (Emotion and Meaning in Music) puede aportar inmensidades en ese aspecto. En este artículo reconstruyo y analizo las respuestas de los escépticos académicos a la objeción de apraxia. Esta objeción afirma que el escepticismo es una doctrina imposible de practicar puesto que sus tesis conducen a la apraxia, esta es, un estado de privación o imposibilidad de acción. Las respuestas a la objeción se dividen en dos clases. La primera prueba que el asentimiento no es una condición necesaria para realizar acciones, por lo que la recomendación escéptica de suspender global y (...) permanentemente el asentimiento no conduciría a la apraxia. La segunda prueba que es posible deliberar y orientar racionalmente nuestras acciones sin impresiones aprehensivas, por lo que la tesis escéptica de que no existen impresiones aprehensivas tampoco conduciría a la apraxia. Tras unas breves consideraciones generales, en la primera parte de este artículo presento las respuestas de Arcesilao y en la segunda parte las repuestas de Carnéades. (shrink)

In recent decades much literature has been produced on disagreement; the puzzling conclusion being that epistemic disagreement is, for the most part, either impossible (e.g. Aumann (Ann Stat 4(6):1236–1239, 1976)), or at least easily resolvable (e.g. Elga (Noûs 41(3):478–502, 2007)). In this paper I show that, under certain conditions, an equally puzzling result arises: that is, disagreement cannot be rationally resolved by belief updating. I suggest a solution to the puzzle which makes use of some of the principles of Hintikka’s (...) Socratic epistemology. (shrink)

El arte no es solamente una fuente inagotable de goce estético, es además una huella, una evidencia de nuestro pasado histórico. A partir del arte es posible remitirnos a nuestra raíz cultural, y es por eso que la obra artística constituye una parte importante del patrimonio de un pueblo. Es evidente el estrecho vínculo entre el patrimonio artístico y la identidad cultural; por eso es importante dar un justo valor a ese patrimonio que, a su vez, se reflejará en la (...) consolidación de una identidad propia. De esas expresiones tomamos únicamente las de la arquitectura de algunas iglesias barrocas. En ellas podemos notar una serie de variables del mestizaje cultural. La arquitectura del barroco novohispano, como uno de los lenguajes del arte, generó una reflexión sobre la identidad del individuo iberoamericano. (shrink)

El presente capítulo tiene la finalidad de describir las diferencias entre un tiempo objetivo de aprendizaje y la temporalidad de la experiencia de aprendizaje. Para esto, cuestiona el paradigma actual de la cognición orientada al procesamiento de la información, donde el tiempo de aprendizaje de la interacción en el aula está susbsumido a un a priori que anticipa el devenir espontáneo de la interacción. En respuesta a lo anterior, proponemos más bien el paradigma contemporáneo de la ecología cognitiva que refuta (...) la idea representacionalista de la cognición y se abre a la dimensión de lo posible que emerge de las interdependencia cerebro-mente-entorno. Se lleva a cabo un planteamiento del estatus de la naturaleza en el ordenamiento jurídico como sujeto y objeto de derechos. Para lograr este objetivo, los autores se valen de una metodología inductiva a partir de un análisis descriptivo desde la doctrina, jurisprudencia y normas primarias. Con ello, se busca, en primer lugar, responder a la cuestión de si es posible o no que un ordenamiento jurídico contemple derechos de la naturaleza; en segundo lugar, se pretende evidenciar cómo el reconocimiento (...) de derechos sobre la naturaleza por parte de la jurisprudencia en Colombia cuenta con presupuestos comunes pese a que aún no se contemplan reglas claras sobre la asignación de derechos a la naturaleza. Al final, se realiza un llamado de atención para comprender esta figura más como un instrumento que el Estado debe utilizar a favor de la naturaleza, que como un decálogo de derechos. (shrink)

Some metaphysicians believe that metaphysical modality is explainable by the essences of objects. In §II, I spell out the definitional view of essence, and in §III, a working notion of metaphysical explanation. Then, in §IV, I consider and reject five natural ways to explain necessity by essence: in terms of the principle that essential properties can't change, in terms of the supposed obviousness of the necessity of essential truth, in terms of the logical necessity of definitions, in terms of Fine's (...) logic of essence, and in terms of the theory of real definitions. I will conclude that the present evidence favours rejecting the hypothesis that modality is explainable by essence. (shrink)

Can we reify the form of a substance? Is it possible to identify DNA as the principle of our personal and numerical identity? These questions will be studied through Berti’s reading of Aristotle’s hylomorphism. Indeed, Enrico Berti proposes the identification of the DNA to the Aristotelian notion of form, thesis which raises many questions from an exegetical point of view and a metaphysical perspective. We will present the sources of Berti’s reading and one of the main objections made by Aristotle. (...) Thus, different versions of the Berti’s thesis will be examined and then, a thought experiment that makes them false. Finally, it will be proposed an aristotelian solution, coming from a contemporary Aristotelian (E. J. Lowe), that seems to prevent Berti’s mistakes and gives us a robust metaphysics of the identity. Expressivists claim that normative judgments (NJ) are non-cognitive states. But what kind of states are they, exactly? Expressivists need to provide us with an adequate account of their nature. Here, I argue that there are structural features that render this task rather daunting. The worry takes the form of a looming dilemma: NJ are either conative states (i.e. states with a world-to-mind direction of fit) or they are not. If they are, then they are either attitudes de se (i.e. attitudes (...) about oneself) or they are not. If they are, then they’re unable to account for disagreement. If they are not, then they're unable to account for agent-relative NJ. So NJ cannot be conative states (they cannot have a world-to-mind direction of fit). On the other hand, however, if NJ are not conative states (if they are states without a direction of fit, like affective or other sui generis non-cognitive, non-conative attitudes) then it remains a mystery how they support relations of disagreement. Background: Several countries have recently changed their model of consent for organ donation from opt-in to opt-out. We undertook a systematic review to determine public knowledge and attitudes towards these models in Europe. Methods: Six databases were explored between 1 January 2008 and 15 December 2017. We selected empirical studies addressing either knowledge or attitudes towards the systems of consent for deceased organ donation by lay people in Europe, including students. Study selection, data extraction, and quality assessment were conducted by (...) two or more reviewers independently. Findings: Awareness of the consent model was lower in opt-out countries than in opt-in countries. A majority of the public agrees with opt-in, regardless of the law in their own country. There are ambivalent attitudes regarding the opt-out system. The public tend to prefer opt-in and mandatory choice over opt-out when several options are offered. Interpretation: The assumption that people in opt-out countries are aware of the legal requirements to be excluded from the pool of potential donors is not supported by the results of this review. This is a concern, since ignorance hinders people's autonomy regarding organ donation decision-making. Higher awareness of consent model in opt-in countries may reflect greater efforts to inform the public through campaigns to motivate donation. Legal moves towards opt-out are at odds with people's expressed preferences. Main limitations of this review are the lack of data from some countries, study population heterogeneity, and methodological shortcomings. (shrink)

According to an influential view, when it comes to representing reality, some words are better suited for the job than others. This is elitism. There is reason to believe that the set of the best, or elite, words should not be redundant or arbitrary. However, we are often forced to choose between these two theoretical vices, especially in cases involving theories that seem to be mere notational variants. This is the riddle of redundancy: both redundancy and arbitrariness are vicious, but (...) there are cases in which one must be picked. Logical realists admit that there are some logical constants among the elite words. This leads to awkward questions, such as which among conjunction and disjunction is elite. In this paper, I show how the riddle of redundancy arises for logical realists, and offer a solution. This approach requires us to change how we represent negation. Instead of using some particular symbol, we represent negation by flipping formulae over the horizontal axis. (shrink)

The Uniform Determination of Death Act (UDDA) provides that “an individual who has sustained either (1) irreversible cessation of circulatory and respiratory functions or (2) irreversible cessation of all functions of the entire brain, including the brain stem, is dead.” We show that the UDDA contains two conflicting interpretations of the phrase “cessation of functions.” By one interpretation, what matters for the determination of death is the cessation of spontaneous functions only, regardless of their generation by artificial means. By the (...) other, what matters is the cessation of both spontaneous and artificially supported functions. Because each UDDA criterion uses a different interpretation, the law is conceptually inconsistent. A single consistent interpretation would lead to the conclusion that conscious individuals whose respiratory and circulatory functions are artificially supported are actually dead, or that individuals whose brain is entirely and irreversibly destroyed may be alive. This document presents the Bonn PRINTEGER Consensus Statement: Working with Research Integrity—Guidance for research performing organisations. The aim of the statement is to complement existing instruments by focusing specifically on institutional responsibilities for strengthening integrity. It takes into account the daily challenges and organisational contexts of most researchers. The statement intends to make research integrity challenges recognisable from the work-floor perspective, providing concrete advice on organisational measures to strengthen integrity. In his article 'Individualism and Descartes' (Teorema, vol. 16, pp. 71-86), William Ferraiolo puts into question the widely accepted interpretation of Descartes as an individualist about mental content. In this paper, I defend this interpretation of Descartes thought against Ferraiolo's objections. I hold, first, that the interpretation is not historically misguided. Second, I try to show that Descartes’s endorsement of anti-individualism would lead either to depriving skeptical hypotheses of their force or to rejecting the epistemological privilege of the first person. Finally, I argue that Ferraiolo’s objections to the individualistic interpretation rest on two important errors: a misapprehension of the argumentative order of the Meditations and a confusion between the notions of causal and constitutive dependence of content on the external environment. Explaining the behaviour of ecosystems is one of the key challenges for the biological sciences. Since 2000, new-mechanicism has been the main model to account for the nature of scientific explanation in biology. The universality of the new-mechanist view in biology has been however put into question due to the existence of explanations that account for some biological phenomena in terms of their mathematical properties (mathematical explanations). Supporters of mathematical explanation have argued that the explanation of the behaviour of ecosystems (...) is usually provided in terms of their mathematical properties, and not in mechanistic terms. They have intensively studied the explanation of the properties of ecosystems that behave following the rules of a non-random network. However, no attention has been devoted to the study of the nature of the explanation in those that form a random network. In this paper, we cover that gap by analysing the explanation of the stability behaviour of the microbiome recently elaborated by Coyte and colleagues, to determine whether it fits with the model of explanation suggested by the new-mechanist or by the defenders of mathematical explanation. Our analysis of this case study supports three theses: (1) that the explanation is not given solely in terms of mechanisms, as the new-mechanists understand the concept; (2) that the mathematical properties that describe the system play an essential explanatory role, but they do not exhaust the explanation; (3) that a non-previously identified appeal to the type of interactions that the entities in the network can exhibit, as well as their abundance, is also necessary for Coyte and colleagues’ account to be fully explanatory. From the combination of these three theses we argue for the necessity of an integrative pluralist view of the nature of behaviour explanation when this is given by appealing to the existence of a random network. The project of growing meat artificially represents for some the next best thing to humanity. If successful, it could be the solution to several problems, such as feed- ing a growing global population while reducing the environmental impact of raising animals for food and, of course, reducing the amount and degree of animal cruelty and suffering that is involved in animal farming. In this paper, I argue that the issue of the morality of such a project has been framed only (...) in terms of the best conse- quences for the environment, animals, and humans, or in terms of deontic princi- ples. I argue that to appreciate how deep and difficult this issue is, it is necessary to consider it in terms of a virtue-oriented approach. Such an approach will reveal aspects that are not apparent, not contemplated by typical approaches, but are essen- tial to our understanding of the morality of lab-grown meat. As I argue, evaluating the issue from a virtue-oriented perspective suggests that the project of in vitro meat should not be supported because it stems from unvirtuous motivations. (shrink)

We present a deductive theory of space-time which is realistic, objective, and relational. It is realistic because it assumes the existence of physical things endowed with concrete properties. It is objective because it can be formulated without any reference to cognoscent subjects or sensorial fields. Finally, it is relational because it assumes that space-time is not a thing but a complex of relations among things. In this way, the original program of Leibniz is consummated, in the sense that space is (...) ultimately an order of coexistents, and time is an order of succesives. In this context, we show that the metric and topological properties of Minkowskian space-time are reduced to relational properties of concrete things. We also sketch how our theory can be extended to encompass a Riemannian space-time. (shrink)

One challenge faced by aesthetics is the development of an account able to trace out the continuities and discontinuities between general experience and aesthetic experiences. Regarding this issue, in this paper, I present an enactive model of some raw cognitive dynamics that might drive the progressive emergence of aesthetic experiences from the stream of general experience. The framework is based on specific aspects of John Dewey’s pragmatist philosophy and embodied aesthetic theories, while also taking into account research in ecological psychology, (...) cognitive sciences, and dynamic systems theory. The model focuses on dynamically relevant nodes at the pre-reflective and the reflective side of experience that would work as nested rhythmic constraints at different cognitive timescales with the potential to shunt experiences toward the aesthetic in everyday situations. My proposal constitutes a way to explore aesthetic experiences from an enactive perspective that regards them as transformative events in which cognitive processes entrain and are entrained by changes taking place in the environment, the brain, and the body. Many moral philosophers have criticized intensive animal farming because it can be harmful to the environment, it causes pain and misery to a large number of animals, and furthermore eating meat and animal-based products can be unhealthful. The issue of industrially farmed animals has become one of the most pressing ethical questions of our time. On the one hand, utilitarians have argued that we should become vegetarians or vegans because the practices of raising animals for food are immoral since they (...) minimize the overall happiness. Deontologists, on the other hand, have argued that the practices of raising animals for food are immoral because animals have certain rights and we have duties toward them. Some virtue ethicists remain unconvinced of deontic and consequentialist arguments against the exploitation of animals and suggest that a virtue-based approach is better equipped to show what is immoral about raising and using animals for food, and what is virtuous about ethical veganism. Although there have never been so many professional philosophers as today, most of the questions discussed by today’s philosophers are of no interest to cultured people at large. Specifically, several scientists have maintained that philosophy has become an irrelevant subject. Thus philosophy is at a crossroads: either to continue on the present line, which relegates it into irrelevance, or to analyse the reasons of the irrelevance and seek an escape. This paper is an attempt to explore the second alternative.

In this paper I deal with Richard Moran's account of self-knowledge in his book Authority and Estrangement. After presenting the main lines of his account, I contend that, in spite of its novelty and interest, it may have some shortcomings. Concerning beliefs formed through deliberation, the account would seem to face problems of circularity or regress. And it looks also wanting concerning beliefs not formed in this way. I go on to suggest a diagnosis of these problems, according to which (...) they would arise out of a view of agents too strongly dependent on the will. /// Este trabajo se ocupa de la concepción del autoconocimiento en el libro de Richard Moran Authority and Estrangement. Tras presentar las líneas maestras de dicha concepción, sostengo que ésta, a pesar de su novedad e interés, podría adolecer de defectos importantes. Así, con respecto a las creencias formadas mediante la deliberación, la propuesta de Moran parece enfrentarse a problemas de circularidad o de regreso. Y parece también insatisfactoria acerca de creencias no formadas de ese modo. In this work we argue that there is no strong demarcation between pure and applied mathematics. We show this first by stressing non-deductive components within pure mathematics, like axiomatization and theory-building in general. We also stress the “purer” components of applied mathematics, like the theory of the models that are concerned with practical purposes. We further show that some mathematical theories can be viewed through either a pure or applied lens. These different lenses are tied to different communities, which endorse (...) different evaluative standards for theories. We evaluate the distinction between pure and applied mathematics from a late Wittgensteinian perspective. We note that the classical exegesis of the later Wittgenstein’s philosophy of mathematics, due to Maddy, leads to a clear-cut but misguided demarcation. We then turn our attention to a more niche interpretation of Wittgenstein by Dawson, which captures aspects of the aforementioned distinction more accurately. Building on this newer, maverick interpretation of the later Wittgenstein’s philosophy of mathematics, and endorsing an extended notion of meaning as use which includes social, mundane uses, we elaborate a fuzzy, but more realistic, demarcation. This demarcation, relying on family resemblance, is based on how direct and intended technical applications are, the kind of evaluative standards featured, and the range of rhetorical purposes at stake. El presente trabajo nació como una reflexión posterior a la traducción del libro de Stanley Cavell Contesting Tears: The Hollywood Melodrama of the Unknown Woman. La reflexión era necesaria habida cuenta de las dudas suscitadas por la traducción del título del libro. Para ser más exacto, la reflexión giraba en torno a las lágrimas que forman parte de la primera parte del título, las lágrimas vertidas por las mujeres desconocidas que protagonizan los melodramas analizados en el libro. En mi opinión, (...) llegar a entender la razón y la naturaleza de esas lágrimas es clave para comprender lo que Cavell nos viene contando desde hace cinco décadas. Por ello, lo que sigue intenta reunir mis propios comentarios sobre la obra de Cavell en general, con la justificación de la traducción final del título: Más allá de las lágrimas. (shrink)

This paper explores the scope and limits of rational consensus through mutual respect, with the primary focus on the best known formal model of consensus: the Lehrer–Wagner model. We consider various arguments against the rationality of the Lehrer–Wagner model as a model of consensus about factual matters. We conclude that models such as this face problems in achieving rational consensus on disagreements about unknown factual matters, but that they hold considerable promise as models of how to rationally resolve non-factual disagreements.

We present an axiomatization of non-relativistic Quantum Mechanics for a system with an arbitrary number of components. The interpretation of our system of axioms is realistic and objective. The EPR paradox and its relation with realism is discussed in this framework. It is shown that there is no contradiction between realism and recent experimental results.
